The Morrison Milling Company ("MMC") appeals a district courts remand of Roxanne Hooks negligence action against the company. MMC argues that Hooks negligence claim is preempted by the Employment Retirement Income Security Act of 1974 ("ERISA"). 29 U.S.C. §Â§ 1001-1461. Because we conclude that Hooks claim does not relate to MMCs ERISA plan, and therefore is not preempted, we affirm the district courts decision to remand Hooks suit to state court.
